What influencers should know about the exclusivity clause in contracts…

Welcome to the Trust Pact where I’m sharing all the deets to help you legally protect your brand. I want you to make and KEEP these coins. Deals and contracts come with alot of legal jargon and it's important that you understand everything, before you sign ANYTHING! I’m here to help you understand all “the legal stuff.”

It may sound like a fairytale to be exclusive with your “dream” brand, but that is only the case if the compensation matches the demands and deliverables that brand is requesting. Exclusivity means that you cannot work with any other brands (as determined by the proposing brand.)

Sometimes they may request that you refrain from working with the other brands totally, or that you stop working with brands while under contract with them, or that you don’t post any other brands during the time the proposed content would go live on social media.

For example, If you landed a deal with Target– they would likely have you sign a noncompete and tell you that you cannot work with similar brands/stores during the time frame. 

Or, if you landed a deal with your favorite skin care company, they probably wouldn’t want you to work with two other brands with skin care products at the same time. That would be really confusing to your audience, and the content probably wouldn’t do very well. 

But, exclusivity clauses can become even more restrictive than just similar/same industry. Brands can actually have you agree to ONLY work with them, no other brands at all. 

Brands want to be sure that they are getting the best response from an influencer’s audience. 

Which is why I always say, brands need YOU, just like you need your coins! 

Here are the two things to note when looking at the exclusivity clause:

  1. How long the duration is- these terms should be clearly laid out and specific.

  2. If the brand is willing to be flexible or are they only willing to collaborate if you are willing to sign a noncompete.

* If number 2 is true, then I encourage you to be sure you are being compensated fairly because you will have to turn down other deals during the duration of your contract.
